About PAIA

The Promotion of Access to Information Act 2 of 2000 (PAIA) gives every person the right to access any information held by a private body, where that information is required for the exercise or protection of any right.

Lofft (Pty) Ltd, trading as Lofft Crew, is a private body as defined in PAIA. This notice sets out how to submit a request for access to information held by us.

Exemption Notice

In terms of the South African Human Rights Commission (SAHRC) Exemption Notice 1 of 2021 (Government Gazette No. 44761, 22 July 2021), private bodies with fewer than 50 employees and an annual turnover below the applicable threshold are currently exempted from the obligation to compile and submit a full PAIA manual.

Lofft (Pty) Ltd currently qualifies for this exemption. Notwithstanding this exemption, we remain committed to transparency and will respond to all valid PAIA access requests in good faith.

How to Submit an Access Request

To request access to information held by us, you must submit a written request to the Information Officer that includes:

  • Your full name and contact details.
  • A description of the information you are seeking.
  • The right you are seeking to exercise or protect, and why the information is required for this purpose.
  • Your preferred format for receiving the information (where applicable).

We will acknowledge your request within 3 business days and respond within 30 days of receipt (or such longer period as permitted by PAIA). We may request proof of identity before disclosing personal information.

A request fee may be applicable in terms of PAIA and the PAIA Regulations. We will notify you of any applicable fee before processing your request.

Grounds for Refusal

We may refuse access to information where disclosure would:

  • Unreasonably disclose the personal information of a third party without their consent;
  • Reveal commercially sensitive or confidential information of Lofft Crew or a third party;
  • Prejudice the safety or security of persons or property; or
  • Constitute a ground for refusal as set out in Sections 63–70 of PAIA.

Appeals

If your request is refused, you may apply to the South African Human Rights Commission for assistance, or approach the court of a competent jurisdiction for a review of the decision.
