Terms of Service

Important: These Terms constitute a legally binding agreement between you and Lofft (Pty) Ltd (Reg. 2026/361759/07), a company incorporated under the laws of the Republic of South Africa, with its principal address at The Avenues, Devine Street, Paarl, 7646, Western Cape, trading as "Lofft Crew". By creating an account or using the platform you agree to be bound by these Terms. If you do not agree, do not use Lofft Crew.

1. Definitions

Lofft Crew / we / us / our means Lofft (Pty) Ltd and its officers, employees, and agents, trading as Lofft Crew.

Platform means the Lofft Crew website and all related services.

User / you means any person who accesses or uses the Platform, whether as a Pilot or an Operator.

Pilot means a User who creates a profile offering their aviation qualifications and availability to Operators.

Operator means a User who subscribes to the Platform to browse Pilot profiles and unlock Pilot contact details, including airlines, charter operators, cargo operators, flight schools, corporate flight departments, private aircraft owners, emergency medical services operators, and agricultural or aerial work operators.

Profile means the information a Pilot submits about themselves, including licence details, ratings, medical certification, flight experience, and employment history.

Verification means Lofft Crew's review of a Pilot's Profile before it is made visible to Operators, as described in Section 5.

Subscription means an Operator's paid, recurring access plan to the Platform.

Contact Unlock means the point at which a subscribed Operator is shown a Pilot's direct contact details.

SACAA means the South African Civil Aviation Authority.

2. About the Platform

Lofft Crew is a directory that connects fixed-wing and helicopter Pilots with Operators seeking to recruit them. Building a Profile is free for Pilots. Operators pay a Subscription to search the directory and unlock Pilot contact details. There is no separate fee charged per hire.

Lofft Crew introduces Pilots and Operators to one another. We are not a party to, and do not become the employer, principal, or agent in, any employment, contracting, or engagement relationship formed between a Pilot and an Operator. Lofft Crew is not a temporary employment service as defined in the Labour Relations Act 66 of 1995 and does not act as an employment agency placing Pilots with Operators.

All Users must be 18 years or older and legally capable of entering into binding contracts under South African law.

Lofft Crew reserves the right to modify, suspend, or discontinue the Platform or any feature at any time with reasonable notice where practicable.

3. Pilot Terms

3.1 Free to Use. Creating and maintaining a Pilot Profile is free. Lofft Crew does not charge Pilots any fee for being listed, contacted, or hired.

3.2 Accurate Information. Pilots must ensure their Profile, including licence type and number, ratings, medical certificate details, flight hours, and employment history, is accurate, current, and kept up to date. Misrepresentation of qualifications is grounds for permanent removal from the Platform and may expose the Pilot to legal liability.

3.3 No Obligation. A Pilot Profile does not obligate the Pilot to accept any approach, interview, or offer from an Operator. Pilots decide independently whether and with whom to engage.

3.4 Independent Status. Pilots are not employees, agents, or partners of Lofft Crew. Any employment or engagement formed with an Operator is a matter solely between the Pilot and that Operator, governed by the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, and any other applicable South African law. Lofft Crew is not a party to, and has no obligations or liability under, that relationship.

3.5 Visibility. A Pilot Profile is only visible to Operators once it has passed Verification (Section 5). Pilots can withdraw their Profile from visibility at any time.

4. Operator Terms

4.1 Subscription Required. Operators must hold an active Subscription to search the Pilot directory and unlock Pilot contact details.

4.2 Permitted Use of Contact Details. An Operator may use a Pilot's unlocked contact details only to genuinely evaluate that Pilot for a role. Operators must not sell, rent, publish, or otherwise share unlocked Pilot contact details with any third party, and must not use them for unsolicited marketing unrelated to a specific role.

4.3 Operator's Own Compliance. Operators are solely responsible for independently verifying a Pilot's credentials before engaging them, for complying with all applicable aviation, labour, and immigration law in respect of any Pilot they engage, and for their own compliance with POPIA when processing a Pilot's personal information after a Contact Unlock.

4.4 Accurate Account Information. Operators must provide accurate company information (company name, type, and contact details) when registering.

4.5 Verification Required. Before an Operator may subscribe or unlock any Pilot's contact details, it must complete Lofft Crew's verification process, including providing accurate company information and proof of how it is authorised to engage Pilots commercially, as described in Section 5.2.

5. Verification & Its Limits

5.1 Pilot Verification. Before a Pilot Profile becomes visible to Operators, Lofft Crew reviews the information and any supporting documents submitted by the Pilot for completeness and plausibility, and conducts a call with the Pilot to confirm their identity and that the Profile information is accurate.

Verification is a review of self-reported information and supporting documents provided by the Pilot. It is not a guarantee that a Pilot's licence, medical certificate, or any other credential is currently valid at the time an Operator views the Profile, and it is not a substitute for an Operator's own due diligence. Licences and medical certificates can lapse after a Profile is verified. Operators must independently confirm a Pilot's current SACAA licence status, medical certificate validity, and any other credential directly with the Pilot and, where appropriate, with SACAA before engaging that Pilot for any flying role.

Lofft Crew may request updated documentation from a Pilot at any time and may suspend a Profile that cannot demonstrate current compliance, but Lofft Crew does not continuously monitor licence or medical certificate expiry on a Pilot's behalf.

5.2 Operator Verification. Before an Operator may subscribe, Lofft Crew reviews the company information the Operator provides, including its stated proof of commercial operation, such as an Air Operator Certificate, an Approved Training Organisation certificate, proof of a Part 91 private operation (including evidence of the aircraft's registration to the Operator), or a written description of how the Operator is lawfully authorised to engage Pilots, together with any supporting documents.

This review is intended to reduce the risk of Pilots being contacted about roles that are not genuine or lawful. It is a review of self-reported information and supporting documents provided by the Operator. It is not a comprehensive audit of the Operator's legal, financial, immigration, labour, or operational compliance, and it is not a guarantee that the Operator's authorisation to operate remains valid at any later date. Pilots remain responsible for their own diligence before accepting any role, in accordance with Section 3.3.

Lofft Crew may request updated documentation from an Operator at any time and may suspend or revoke an Operator's verified status, subscription, or access to the Platform if it can no longer demonstrate a legitimate basis to engage Pilots commercially.

6. Subscriptions & Payments

6.1 Payment Processing. Operator Subscriptions are billed via Paystack (Pty) Ltd, a licensed payment service provider. By subscribing, you authorise Lofft Crew to charge your chosen payment method on a recurring basis until you cancel.

6.2 Currency. Subscription fees are denominated in South African Rand (ZAR).

6.3 Auto-Renewal. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.

6.4 Price Changes. Lofft Crew may change Subscription pricing from time to time. Any price change will be communicated to active subscribers in advance and will take effect from the next billing period.

6.5 VAT. Lofft (Pty) Ltd is not registered for value-added tax (VAT) purposes under the Value-Added Tax Act 89 of 1991. No VAT is levied on Subscription fees, and no VAT invoice will be issued.

7. Cancellations & Refunds

Our full Refund & Cancellation Policy forms part of these Terms. In summary: Operators may cancel their Subscription at any time; cancellation stops future billing but does not refund the current billing period already paid for. Nothing in this Section limits any statutory right you may have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.

8. Liability

8.1 Lofft Crew's Role. Lofft Crew operates a directory and introduction service. We do not employ, supervise, direct, or vouch for the ongoing competence of any Pilot, and we do not vet, guarantee, or take responsibility for an Operator's workplace conditions or compliance with South African labour or aviation law.

8.2 No Guarantee. Lofft Crew does not guarantee that any Pilot Profile is accurate, current, or that any Pilot is fit for a particular role, nor that any Operator will make contact, extend an offer, or behave professionally. Lofft Crew is not liable for any dispute, loss, or harm arising from an employment or engagement relationship formed through the Platform, whether or not that relationship is reported to us.

8.3 Limitation of Liability. To the maximum extent permitted by South African law, Lofft Crew's total aggregate liability to any User for any claim arising out of or relating to these Terms or use of the Platform shall not exceed the greater of (a) the Subscription fees paid by that User to Lofft Crew in the 12 months preceding the claim, or (b) R5 000. Lofft Crew is not liable for any indirect, incidental, consequential, or punitive damages.

8.4 No Warranty. The Platform is provided "as is" without any warranty of fitness for a particular purpose, uninterrupted availability, or absence of errors.

9. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
  • Post false, misleading, or fraudulent information in a Profile or account.
  • Scrape, bulk-export, or systematically extract Pilot Profiles or contact details other than through the Platform's intended features.
  • Share, resell, or publish unlocked Pilot contact details to any third party.
  • Harass, threaten, or abuse other Users.
  • Attempt to gain unauthorised access to the Platform or other Users' accounts.
  • Create multiple Operator accounts to avoid paying for a Subscription.

10. Intellectual Property

10.1 Platform IP. The Lofft Crew brand, logo, software, and all platform content (excluding user-submitted content) are the intellectual property of Lofft (Pty) Ltd. You may not copy, modify, or distribute them without written consent.

10.2 Profile Content. Pilots retain ownership of the content they submit to their Profile. By submitting it, you grant Lofft Crew a non-exclusive, royalty-free licence to display that content to Operators for the purpose of operating the Platform, for as long as your Profile remains active.

11. Disputes

11.1 Marketplace Role. Lofft Crew is a directory that facilitates introductions between Pilots and Operators. Any resulting employment, contracting, or engagement relationship exists directly between the Pilot and the Operator; Lofft Crew is not a party to it.

11.2 Good Faith. Users are expected to resolve disputes about the accuracy of a Profile, the conduct of a User, or a resulting engagement directly and in good faith. Lofft Crew may, at its discretion, review a complaint about Profile accuracy or User conduct and take action against an account, but does not adjudicate disputes about employment terms, pay, or the outcome of an engagement between a Pilot and an Operator.

11.3 Governing Law. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute that cannot be resolved informally shall be subject to the jurisdiction of the Western Cape High Court, Cape Town.

11.4 Consumer Commission. Nothing in these Terms prevents a User from approaching the National Consumer Commission, a provincial consumer court, or an industry ombud for relief under the Consumer Protection Act 68 of 2008.

11.5 Informal Resolution. Before initiating any formal legal proceedings, Users agree to contact Lofft Crew at support@lofft.co.za and give us a reasonable opportunity (not less than 30 days) to resolve the matter informally.

12. Termination

Lofft Crew may suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or if we determine that your continued use poses a risk to other Users or the Platform.

You may close your account at any time by contacting us at support@lofft.co.za. Any outstanding Subscription obligations survive account closure until the current billing period ends.

Upon termination, Lofft Crew may retain certain data as required by applicable law or legitimate business interests, in accordance with the Privacy Policy.

13. General

13.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lofft Crew with respect to the Platform and supersede all prior agreements.

13.2 Severability. If any provision is found unenforceable, the remaining provisions continue in full force.

13.3 Changes. Lofft Crew may update these Terms from time to time. We will notify registered Users by email and post the updated Terms on the Platform. Continued use after the effective date constitutes acceptance of the updated Terms.

13.4 Domicilium. Lofft Crew chooses the following address as its domicilium citandi et executandi for the service of all legal notices and documents:

13.6 Not a Credit Provider. Lofft Crew is not a credit provider as defined in the National Credit Act 34 of 2005.
